ETAMOR CIVIC TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the Etamor Civic application, website and related services ("Etamor Civic" or the "Services").

The Services are operated by Etamor Private Limited, a company incorporated under the laws of India ("Etamor", "Company", "we", "us" or "our").

By creating an account or using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree, you should not use the Services.

1. PURPOSE OF ETAMOR CIVIC

Etamor Civic provides technology intended to facilitate civic reporting, civic communication, community participation and related services.

Among other things, users may be able to:

  • Report civic problems;
  • Submit photographs, videos and supporting evidence;
  • Provide the location of civic issues;
  • Receive updates concerning reports;
  • Communicate through community features;
  • Participate in a Reputation System;
  • Access information relating to civic or emergency services; and
  • Use optional emergency assistance functionality.

The availability of individual features may vary by location, account, application version or technical availability.

2. ACCOUNT INFORMATION

You agree to provide accurate and current information when creating and maintaining your account.

You must provide your real name and a valid mobile number belonging to you. Where requested, your name should correspond with the name appearing on a valid government-issued identity document, such as a driving licence or passport.

Unless expressly stated as part of a separate verified service, Etamor does not independently verify your identity against Aadhaar or another government database.

You must use a valid phone number and email address where requested because Etamor or relevant authorities may need to contact you regarding reports submitted through your account.

You must promptly update materially inaccurate account information.

3. NEVER SHARE SENSITIVE CREDENTIALS

Etamor does not require users to disclose passwords or OTPs to Etamor personnel.

Unless a specific lawful process expressly requires particular information and clearly explains why it is required, users should not provide:

  • Aadhaar numbers;
  • PAN numbers;
  • Passport numbers;
  • Bank account credentials;
  • Credit or debit card information;
  • Passwords;
  • OTPs; or
  • Other authentication secrets.

If someone claiming to represent Etamor requests such credentials, do not provide them and report the incident through the Help section.

4. ACCOUNT SECURITY AND INTEGRITY

You are responsible for activity conducted through your account unless the activity results from circumstances for which Etamor is legally responsible.

You may not:

  • Share or transfer your account in violation of these Terms;
  • Impersonate another person;
  • Misrepresent your identity;
  • Create fake organisations;
  • Create accounts for deceptive purposes;
  • Use automated systems or bots to manipulate civic reports;
  • Artificially manipulate the Reputation System;
  • Circumvent suspensions or bans; or
  • Attempt to obtain unauthorised access to another user's account.

Notify Etamor promptly if you believe your account has been compromised.

5. CIVIC REPORTING RULES

Civic reports should be made in good faith.

When submitting a report, you agree that, to the best of your knowledge:

  • The report concerns a genuine issue;
  • Material factual statements are accurate;
  • Evidence has not been intentionally manipulated to mislead;
  • The report is not knowingly false;
  • You are not using the reporting system to harass another person; and
  • You will provide reasonable clarification where necessary.

You do not need to prove a complaint with absolute certainty before reporting a genuine issue.

However, intentionally submitting false, fabricated, deceptive or malicious reports is prohibited.

6. PROHIBITED REPORTS AND CONTENT

You may not knowingly use Etamor Civic to:

  • Submit fabricated civic complaints;
  • Falsify evidence;
  • Harass or threaten another person;
  • Impersonate public officials;
  • Manipulate report statistics;
  • Coordinate artificial reporting campaigns;
  • Submit malicious duplicate reports;
  • Publish another person's sensitive personal information without lawful justification;
  • Commit fraud;
  • Distribute malware;
  • Attempt unauthorised access to systems;
  • Interfere with the operation of Etamor Civic;
  • Encourage violence or unlawful conduct;
  • Exploit or endanger children;
  • Post unlawful content; or
  • Use the Services in a manner prohibited by applicable law.

Good-faith disagreement, criticism of Etamor, criticism of government services or criticism of public policy does not by itself constitute misuse of the platform.

7. EVIDENCE AND MEDIA

You may submit photographs, videos and other material relevant to a civic report.

You represent that you have the right or lawful basis to submit the material.

You should avoid unnecessarily recording or exposing private individuals, private documents, vehicle information, residential information or other personal data where it is not relevant to the civic issue.

Etamor may remove, obscure, restrict or decline to forward material that creates privacy, safety or legal concerns.

8. LICENCE TO PROCESS SUBMITTED CONTENT

You retain ownership of content you create to the extent you hold rights in that content.

By submitting content to Etamor Civic, you grant Etamor a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt where technically necessary, display and transmit that content to the extent reasonably necessary to:

  • Operate Etamor Civic;
  • Process the report;
  • Send information to relevant authorities;
  • Investigate or verify reports;
  • Display content where the relevant feature is public;
  • Prevent abuse;
  • Maintain records;
  • Improve the reporting system; and
  • Comply with legal obligations.

This licence does not transfer ownership of your original content to Etamor.

9. FORWARDING REPORTS TO AUTHORITIES

Etamor may forward civic reports and relevant supporting information to appropriate government bodies, civic authorities, utilities, contractors or other organisations responsible for the reported matter.

Submitting a complaint through Etamor does not guarantee:

  • Acceptance by a government authority;
  • Investigation;
  • Resolution;
  • A particular response time;
  • Government action;
  • Compensation; or
  • Any specific outcome.

Unless expressly stated for a particular service, Etamor is not itself the government authority responsible for repairing or resolving the reported civic problem.

10. COMMON ROOM

Etamor Civic may provide a community communication area known as the Common Room.

The Common Room is intended for lawful and constructive communication.

Users may not use it for:

  • Threats;
  • Targeted harassment;
  • Unlawful hate content;
  • Sexual exploitation;
  • Fraud;
  • Spam;
  • Malicious impersonation;
  • Doxxing;
  • Publication of another person's private information without lawful justification;
  • Coordinated manipulation;
  • Illegal transactions;
  • Malware or malicious links; or
  • Other unlawful content.

Etamor may moderate the Common Room and may remove or restrict content or accounts where reasonably necessary to enforce these Terms, protect users, comply with applicable law or maintain the integrity of the Services.

11. MODERATION

Etamor may use human and/or automated systems to identify spam, abuse, prohibited content, duplicate complaints, manipulation and other violations.

Moderation systems may make mistakes.

Where appropriate and technically available, users may be permitted to report content or request review of certain moderation decisions.

Etamor does not endorse every statement made by users merely because it appears on the platform.

12. REPUTATION SYSTEM

Etamor Civic may operate a Reputation System.

Users who consistently contribute reliable reports, verified evidence and useful updates may receive higher trust or reputation scores.

Users who repeatedly violate platform rules may receive:

  • A warning;
  • Feature restrictions;
  • Temporary suspension; or
  • Permanent suspension or termination.

The severity of enforcement may depend on the nature of the violation.

Etamor is not required to apply each step sequentially. Serious abuse, fraud, threats, emergency-system misuse, platform attacks or unlawful activity may result in immediate restriction or termination.

13. EMERGENCY SERVICES

Etamor Civic may provide contact information or functionality allowing users to contact appropriate emergency services.

Users facing emergencies such as:

  • Fire;
  • Medical emergencies;
  • Active crime; or
  • Immediate danger

should contact the appropriate official emergency service directly whenever possible.

Etamor may additionally provide an optional emergency assistance feature designed for extreme situations, including serious threats to life or emergencies arising from disasters or other dangerous circumstances.

Users may be able to enable this feature in their settings and configure emergency contacts.

14. EMERGENCY ALERT FUNCTION

When you deliberately activate the Etamor Civic emergency alert function, you authorise Etamor to process and transmit information necessary to facilitate that alert.

Depending on configuration and availability, the information may include:

  • Your identity information;
  • Phone number;
  • Device location;
  • Time of activation;
  • Emergency information;
  • Selected emergency-contact information; and
  • Optional device information you have permitted Etamor to access.

This information may be transmitted to configured emergency contacts and/or appropriate police or emergency authorities where the relevant integration is available.

15. EMERGENCY SERVICE LIMITATIONS

ETAMOR CIVIC IS NOT A POLICE CONTROL ROOM, AMBULANCE SERVICE, FIRE SERVICE OR GOVERNMENT EMERGENCY DISPATCH SYSTEM UNLESS A PARTICULAR SERVICE EXPRESSLY STATES OTHERWISE.

The emergency feature is intended to supplement—not replace—official emergency channels.

Etamor cannot guarantee that:

  • An emergency alert will successfully transmit;
  • Device location will be available or accurate;
  • Internet or mobile connectivity will be available;
  • A recipient will receive the alert;
  • A recipient will immediately view the alert;
  • Police or another authority will respond;
  • An emergency contact will respond; or
  • Assistance will arrive within any particular period.

Technical failures, depleted batteries, disabled permissions, poor connectivity, GPS inaccuracies, server outages, device restrictions and circumstances outside Etamor's control may affect the feature.

If you can safely contact official emergency services directly, you should do so rather than relying exclusively on Etamor Civic.

Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.

16. EMERGENCY SYSTEM MISUSE

The emergency system must only be used in good faith.

Users must not knowingly:

  • Trigger false emergency alerts as a prank;
  • Repeatedly test live emergency dispatch functionality without authorisation;
  • Send fabricated emergencies;
  • Use the system to harass police, emergency contacts or another person;
  • Falsify location or identity information to mislead emergency recipients; or
  • Attempt to overload or disable the emergency system.

Serious or repeated misuse may result in immediate account suspension or termination and may be reported to competent authorities where appropriate or required by law.

17. DEVICE AND LOCATION PERMISSIONS

Some features require access to device capabilities.

Etamor will request permissions where appropriate.

Certain permissions may be optional.

For example, where offered, users may choose whether to share device information such as device type and battery percentage for supported functionality.

Users can generally manage permissions through their device or application settings.

Disabling a permission may cause related features to stop functioning.

18. THIRD-PARTY SERVICES

Etamor Civic may interact with third-party services, maps, government systems, telecommunications services or other platforms.

Etamor does not control independent third-party services and is not responsible for their availability, content or actions except to the extent required by applicable law.

19. INTELLECTUAL PROPERTY

Except for user-generated content and third-party material, the Etamor Civic application and associated software, designs, branding, graphics, databases and other proprietary material are owned by or licensed to Etamor and are protected by applicable intellectual-property laws.

You may not copy, reverse engineer, reproduce, redistribute or commercially exploit protected Etamor material except as permitted by applicable law or with our permission.

20. SERVICE AVAILABILITY

We aim to maintain reliable Services but cannot guarantee uninterrupted operation.

Features may occasionally become unavailable due to:

  • Maintenance;
  • Technical failures;
  • Security incidents;
  • Connectivity failures;
  • Government-system outages;
  • Third-party failures;
  • Updates;
  • Events beyond our reasonable control; or
  • Other operational requirements.

21. CHANGES AND NEW FEATURES

Etamor Civic is an evolving service.

We may add, modify or discontinue features to improve the civic reporting system, user experience, safety or functionality.

Users are encouraged to keep the application updated.

Where a change materially affects your rights or the processing of personal data, additional notice or consent may be provided where required by applicable law.

22. SUSPENSION AND TERMINATION

Etamor may restrict, suspend or terminate an account where reasonably necessary because of:

  • Serious or repeated violations of these Terms;
  • Fraud;
  • False emergency alerts;
  • Manipulation;
  • Security threats;
  • Unlawful activity;
  • Attempts to compromise Etamor systems;
  • Serious harassment or threats; or
  • Legal requirements.

Where appropriate, we may provide notice or an opportunity to seek review.

Users may stop using Etamor Civic and may request account deletion using available account controls.

23. DISCLAIMERS

Etamor provides a technology platform intended to facilitate civic reporting and related functionality.

Unless expressly stated otherwise:

  • Etamor does not control government authorities;
  • Etamor cannot compel a public authority to resolve a report;
  • User-generated information may be inaccurate;
  • Civic-report status information may depend upon information received from third parties; and
  • Emergency functionality is not guaranteed to result in emergency assistance.

Nothing in these Terms limits rights or remedies that cannot legally be waived under applicable Indian law.

24. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Etamor will not be liable for indirect, incidental, special or consequential losses arising solely from circumstances outside Etamor's reasonable control.

This provision does not exclude or restrict liability where doing so would be prohibited by applicable law, including liability arising from fraud, wilful misconduct or other liability that cannot legally be excluded.

25. INDEMNITY

To the extent permitted by applicable law, you agree to be responsible for losses, claims or liabilities reasonably arising from your intentional unlawful use of the Services, fraudulent submissions, deliberate infringement of third-party rights or material violation of these Terms.

This provision does not make a user responsible for losses caused by Etamor's own unlawful conduct.

26. PRIVACY

Use of Etamor Civic is also governed by the Etamor Civic Privacy Policy.

The Privacy Policy explains the categories of personal data Etamor processes and the purposes for which it is used.

27. USER GRIEVANCES

Users can report:

  • Technical problems;
  • Civic-reporting problems;
  • Account problems;
  • Privacy concerns;
  • Common Room content;
  • Suspected impersonation;
  • Suspicious requests for personal information;
  • Moderation concerns; or
  • Other complaints concerning Etamor Civic

through the application's Help section or by contacting:

28. CHANGES TO THESE TERMS

We may update these Terms as the Services, applicable law and Etamor Civic features evolve.

Material changes may be communicated through the application, website, email or another reasonable method.

Where required by applicable law, we will obtain renewed acceptance or consent.

Continued use after an update will be treated in accordance with applicable law.

29. GOVERNING LAW

These Terms are governed by the laws of India.

Subject to applicable consumer-protection laws and any other mandatory jurisdictional requirements, disputes relating to these Terms shall be subject to the jurisdiction of the competent courts at Lucknow, Uttar Pradesh, India.
